DISCLAIMER & TERMS OF SERVICE

All outdoor activities have an unpredictability factor and includes risks. These apparent risks involved, are considerably controlled by our staff and support personnel to facilitate a fun filled environment. We provide a safe and controlled environment to the participants by following health and safety processes of supervision, inspection and instructions. However, these controlled risks that involve facing physical as well as mental challenges cannot be completely eliminated as we cannot name, control or remove every kind of risk. The participating individuals would have the opportunity to engage in activities on natural and artificial structures and all activities would be by Choice of the individual participant. One must therefore understand that there are risks that can result in an injury. Without being alarmed you must be conscious to the fact that activities do include some inherent risk.

 

All Travelling Particle (Wandererz) events take place in the great outdoors. The success of these events depend upon various factors which include climatic conditions, governmental / quasi-governmental policies, mechanical and human error in hired vehicles, etc. and despite checks and double checks, there is always a possibility that the event may not see through as planned or advertised. Travelling Particle (Wandererz) and its representatives do everything in their reasonable capacity to ensure the smooth running of an event and stick to the advertised plan. However, in the situation that an event has to be shortened or cancelled, Travelling Particle (Wandererz) would stand liable to refund only the balance amount of the total amount paid after deductions of the actual cost incurred up to the moment.

 

Some tourist destinations in India charge different and higher fees for foreigners, and also charge for usage of Camera -Video Recorder and the same would have to be borne separately by such a participant.

Travelling Particle (Wandererz) and its representatives do not subscribe to or encourage the consumption of any Alcoholic and/or Narcotic and Psychotropic substances during an event. Not only does the consumption thereof compromise the safety of the individual and the group physically, but also legally. Any participant who does not adhere to this policy during the event would automatically stop being a part of the event and be asked to make private arrangements for themselves thereon, without receiving any refund whatsoever.

If I REGISTER for the event, what does it mean?

• You understand the type of activities you will be part of and are aware of the inherent risk that exists in all outdoor activities.

• You are medically fit to undertake such activities.

• You understand that you will need to act responsibly and reasonably and follow all the rules.

• You understand that although organizers (Travelling Particle) take safety seriously, they cannot remove all risks.

• You give your permission in unlikely event of an injury/accident, to Travelling Particle (Wandererz)  to provide basic first-aid.

 

DECLARATION

• I hereby agree that I will follow the instructions stated by the event conductor.

• I further undertake that I will not indulge in usage of alcohol-narcotics throughout this event.

• I understand that the activity is time consuming which might make us reach back home late at night and also challenging in nature.

• I understand that, unless otherwise mentioned, cost incurred for these activities will be borne by me.

• I recognize the fact that outdoor activities have the risk of strain, fatigue, danger of personal injury etc; and in participating in these activities I am exposed to these dangers. I agree to assume all risks such as personal injury, loss of life, or property loss or damage. I understand that Travelling Particle (Wandererz) has taken reasonable care and precautions for my safety. I further understand that I am solely responsible for my actions and will not hold Travelling Particle (Wandererz) or its founders, staff or any of its support personnel or any other organization/ individual, accountable for consequences arising out of any of the aforesaid risks / danger.

 

• I also understand that all outdoor activities are conducted in places that have access to only basic facilities in a non-luxurious environment. I understand and agree that Travelling Particle (Wandererz) does not represent or serve as agent for and cannot control the acts or omissions of other institutions, transportation carriers, hotels and other suppliers of goods and/or services connected with the above mentioned purpose. I agree Travelling Particle (Wandererz) is not responsible for any personal injury to or loss of life to me or loss or damage to property that may be caused or contributed to by the act or omission of another institution or any services in connection with the above mentioned purpose.

 

• I understand and agree to fact that no medical facilities like doctor or medicines will be available during event. Further due to terrain of event, evacuation & rescue in case of mishap will also be very difficult. I agree to bear all cost related to any such incidence.

• If my medical condition changes, or if I receive an injury after signing this form, I will disclose it to Travelling Particle (Wandererz) before the start/during the event.

• I agree to authorize Travelling Particle (Wandererz), during the activity to approve such basic medical treatment as is deemed necessary for me in an emergency and/or in accordance with the recommendations of a qualified medical practitioner.

• I understand that injuries-accidents arising out of these activities will not be covered by Travelling Particle (Wandererz) and I will arrange for payments for medical treatments in case of injury/accidents.

• I hereby agree to waive any and all claims that I have or may have in the future against Travelling Particle (Wandererz) and to release Travelling Particle (Wandererz) from any and all liability for any loss, damage, expense or injury including death that I may suffer as a result of the above mentioned purpose.

• I hereby agree to hold harmless and indemnify Travelling Particle (Wandererz) from any and all liability for any property damage or personal injury to any third party resulting from the above-mentioned purpose.
